Can You See Me Now?

 

A new law goes into effect on December 20, 2020, banning Internet Service Providers (ISPs) from charging a rental fee to consumers for company equipment such as modems and routers even when consumers prefer to use their own equipment instead. For years, ISPs have gotten away with charging rental fees on the basis of network compatibility and service support, conveniently ignoring instances where equipment owned by consumers may be the equal of equipment provided by the ISPs, or even superior to it. This was a situation rather like a subscription meal service grabbing an additional monthly fee for the rental of its proprietary tableware and cutlery, regardless of whether the subscriber already possessed adequate means to prepare and eat the provided meals.

This is no small matter in these times of exponentially increasing broadband internet use as video conferencing, a bandwidth hog, has taken off with businesses, consumers, and students and their schools because of the demands of the coronavirus pandemic. When parents are working on their computers at home, using Zoom or any of a half dozen other video conferencing applications to stay in touch with employers, employees, and clients, and at the same time their children are at home learning remotely from teachers on their computers, also using video conferencing, the demands on a home router are greater than ever before, and the consequences of poor performance are more critical than they would be for streaming entertainment during hours off from work or school.

Now that ISPs are no longer allowed to penalize consumers for using their own equipment, the next step is to make it easier for consumers to ascertain compatibility of any equipment with their provider’s network and service plans. It’s understandable that 1Gbps (Gigabit per second) service requires a modem capable of handling that speed of throughput, and that a router handling data requests from multiple devices simultaneously needs to be more robust than a router dedicated to only one device. ISPs and equipment manufacturers should make it easy for consumers to determine compatibility prior to purchase, rather than blindly trying to match equipment to service through trial and error.


For many years, Henri, Le Chat Noir (The Black Cat), was the star of short films featuring his dour philosophical musings. Henri, who retired a couple of years ago, died earlier this month, but his legacy lives on among internet surfers as one of the first standouts in the cat video genre, and always among the best.

 

Better communication between ISPs and equipment manufacturers could develop standards that can be easily determined by consumers through labeling of a piece of equipment’s network compatibility and its minimum and maximum performance capabilities, cross referenced with the network’s requirements for safe and effective performance. Such easily referenced labeling will free up everyone’s time and energy for more worthwhile pursuits, like watching cat videos when they’re not on Zoom calls.

Elon Musk’s SpaceX has sent hundreds of internet communications satellites into low Earth orbit, and has plans to launch thousands more such satellites in the near future. Other companies, among them Jeff Bezos’s Amazon, have similar plans. Within the span of several years, the number of satellites launched into orbit could double from the amount that have been launched since the beginning of the Space Age in 1957. The clutter could interfere with astronomers’ observations and measurements, and even with casual enjoyment of the night sky by lay people.

There are terrestrial alternatives to webbing near Earth space with tens of thousands of satellites in order to get internet service to rural communities around the world. in the United States, rural electric cooperatives have worked steadily for years to overcome infrastructure and regulatory obstacles to provide internet service along the last mile to their members. It is the big telecommunications and cable television companies, with their friends in big government, that have often made operations difficult for alternative internet service providers. Even when the local governments of towns and small cities try to cooperate with small internet service providers, their efforts are often undercut and overruled by larger government entities working at the behest of large corporations that will brook no competition.

Now comes SpaceX’s Starlink and Amazon’s Project Kuiper, backed by their founders’ deep pockets and enabled by their existing links to big government, links that will only strengthen and deepen as the companies take over near Earth space and provide launching and communications services to government agencies. The partnership with government may even prove to be the primary consideration for both companies, and providing internet service to private individuals a secondary, though lucrative consideration. The partnership could develop into a Space Age equivalent of the British East India Company’s close association with the British Empire, which saw the two entities merging in so many areas public and private that eventually one could hardly tell where one left off and the other began.



In addition to the Space Age, the modern era has come to be known as the Information Age. The internet via the world wide web has become the chief vector of information in these times and, as many have often observed, information is power. In the days when the British East India Company held sway along with equivalent companies sanctioned by other European powers, trade goods from far off lands were the valued currency that governments sought to procure and protect. Governments guarded the trade routes to and from the far off lands as well as the lands themselves. Over time, the various East India Companies adopted their own paramilitary arms to protect their interests. Similar relationships could develop in the coming years as companies seek the help of government in protecting their interests in space in return for providing essential services.

Why should SpaceX, for instance, invest hundreds of billions of dollars in the infrastructure needed to establish colonies in space with the potential for enormous profitability in the long run without being assured tens of billions of dollars in government contracts in the short term and the perpetual cash cow of providing internet service to billions of people every day? Look up in the night sky for answers and soon enough you’re likely to see the winking reflections off tens of thousands of satellites, glinting like dew along the strands of a spider’s web.

Nearly as Good as New

 

The past thirty years have been a golden age of film restoration, starting with the 1989 restoration of the 1962 film Lawrence of Arabia. Robert Harris led that work, and he has had a hand in restoring many films since then, including Vertigo (1958) and My Fair Lady (1964). It’s a shame that great movies need restoration at all, a state of affairs principally due to neglect by the very studios that made them, often at a cost of millions of dollars. Hollywood studios were far less concerned about art or historical preservation than they were about business, and movies retained little value for the studios after their initial theatrical release.

Indeed that was the situation for movies until home video opened a new and lucrative avenue for the studios in the 1970s and 1980s. Until then, to the extent the movie studios kept original film elements at all, they kept them in slipshod conditions which allowed the films to deteriorate to one degree or another. By the time demand returned for some of the better movies, restoration was necessary to have a salable product. VHS (Video Home System) tapes could skate by with no restoration because of the low resolution of the format, but laser disc was several steps above VHS in quality and created the first push to restore old films.

Laser disc never caught on the way VHS did, however, and its appeal was limited to cinema buffs. The biggest nudge toward film restoration came in the 1990s with the popularity of DVD (Digital Video Disc), an improvement in quality over VHS at about the same price for content and playback equipment. With that change in the market, movie studios saw the value in packaging their backlog of films in the new format, creating a greater need to restore at least some of those in highest demand. Since the turn of the century, high definition televisions and further improvements in home video resolution have brought the home theater experience into the mainstream, and the demand for quality restorations of old films is at a peak and will probably stay on a plateau hereafter.

There is a limit to how much detail the human eye can discern in the limited space of the typical home theater. DVD was a huge improvement over VHS, and Blu-ray was almost as big an improvement over DVD. 4K resolution is not quite as great an improvement over Blu-ray as numbers alone would suggest, simply because the law of diminishing returns starts to take effect. In the confines of a home theater, even using the best equipment, viewers are less able to discern the finer detail there on the screen. 8K resolution is overkill for all but the most dedicated home video enthusiasts with deep pockets.

Another reason for home video improvements driving film restorations less in the future is the switch by consumers from owning content on physical media, such as a Blu-ray disc, and streaming content in a rental agreement over the internet. Already the rollout of 4K discs has slowed to the point that many good old movies may never be remastered for the format. The potential sales aren’t high enough to interest the major movie studios. As to streaming 4K content, that is subject to the vagaries of the consumer’s internet connection. Some of the 4K content may not be as advertised because of the huge bandwidth requirements, and streaming true 8K content would probably require a 5G internet connection and an actual unlimited data plan from a viewer’s Internet Service Provider (ISP).


In any event, these are good times for fans of old movies. Some classic films, like director John Huston’s 1956 version of Moby Dick, which have long deserved restoration but were nonetheless neglected for whatever reason by the major studios, have been restored by smaller distributors of home video content who have determined it would be worth their time and effort. The movie studio Paramount last year restored It’s a Wonderful Life (1946) and remastered it in 4K, though in a sign of the times they have released the new version only for streaming and have not pressed discs of it. Another classic film, Life with Father (1947), awaits true restoration, and viewers should meanwhile beware the versions for sale which trumpet digital remastering or restoration.

Like It’s a Wonderful Life, Life with Father had also fallen into the public domain; unlike It’s a Wonderful Life, Life with Father has not attracted anew the attention of the major studios. While Paramount has lavished care on restoring It’s a Wonderful Life, slapdash outfits have been appropriating Life with Father for the sales catalog, offering horrendously bad versions of it and relying on the phrases “digitally remastered” and “restored” to dupe the ignorant. They hope naive consumers will infer that “digitally remastered” means “improved”. It means no such thing; it means only that the film has been scanned to a digital format, a necessary step in making analog movie film available for home viewing on a DVD, Blu-ray, or 4K player. “Restored” is a relative term and can mean the absolute minimum amount of work was put into it, as is usually the case with the shadier outfits.

Check reviews online, preferably not on Amazon because the reviewers there rarely get to the nitty gritty about the quality of the transfer, and instead prefer to bloviate about the movie itself, seeing it as their chance to be an authoritative movie reviewer like Roger Ebert. Better are the reviews on news sites or websites specializing in film industry or home theater matters because they generally do mention the quality of the transfer, though consumers still have to take some of those reviews with a grain of salt when they include affiliate links to sites selling copies of the movie. Be wary during research and you’ll have less chance to regret a purchase and better enjoyment of a great old movie given the attention it deserves.

Cursing the Darkness

 

There are some people who are so afraid of change that they would rather curse the darkness of their current situation than light a candle to change it. Such people curse an onerously expensive Comcast or Charter cable television and internet bill and the infamously poor customer service of those companies, and yet when they are presented with alternatives they hem and haw and drag their feet about contacting a competitor to the large cable television and internet providers. Part of the problem is fear of change, and part of it is the desire to continue having all of everything, all at once.

 

People living in or near cities have choices of providers for their television and internet services, while choices for people living in the countryside are far more limited. Nevertheless, while choices may be limited, they are available to people everywhere in the United States who are willing to forego having daily access to obscure specialty channels on cable television or to hundreds of GigaBytes (GB) of data each month for streaming content over the internet. People have to be willing to give up the passivity of slouching on their couches and letting Comcast do everything for them. If that’s what they want, then fine, but don’t expect everyone else to be sympathetic to complaints about high monthly bills for lousy service. Curse the darkness to yourself if you’re unwilling to light a candle to help yourself.

For everyone else, there is research to be done, most likely over the internet, a job for which it is very well suited. Research options for internet service providers other than the large companies. You may have to make sacrifices in one way or another when changing to a local, small scale provider, but that is part of cutting the cord. It’s like changing from buying most of your groceries at a national or regional chain grocer to buying them from a local farmers’ market or independent grocer. City dwellers will of course have more options when it comes to technology than country folks, but the important thing to realize is that there are options, as long as people ditch the idea of having all of everything done for them all at once.

The same thing applies to television service, which starts with cutting the cord without bothering to find a new cord provider. Get an antenna! Local television stations are adding digital subchannels every year, and receiving them with an antenna costs nothing. The two key things to remember in buying an antenna are that there is no such thing as a digital or high definition television antenna (an antenna is an antenna, built to receive electromagnetic frequencies regardless of whether the content of those signals is analog or digital), and that resolving digital television content requires a slightly more powerful antenna than in the old days of resolving analog content. Where a rabbit ears antenna may have done the job before, today an outdoor antenna may be necessary for adequate reception.

A nice story from the actor, Jamie Farr, about his early days struggling to make a living in Hollywood. Documentaries like this are much easier to find now on the internet than on cable television.

Some folks who are fortunate enough to have hundreds of GigaBytes of internet data available each month at a reasonable price can do away with cable or antenna television service altogether, and instead use their internet service for viewing television. Do your research! Ask questions of yourself first about what it is you watch most and can’t do without. How many different ways are there to receive that programming? Chances are there are multiple ways of receiving your favorite content, and continuing to rely solely on companies like Comcast and Charter is a disservice to yourself and a way of continuing to curse the darkness. To take documentaries – serious documentaries, that is, not Shark Week documentaries or anything involving Guy Fieri – as one example, it is obvious that cable television offerings have been replaced in the past ten years by what’s available for free on YouTube and by subscription on services such as Netflix. Don’t keep sitting in the dark – light a candle, just don’t expect it to vanquish all the shadows in your life.

Don’t Hold Your Breath

 

Ten or more years ago there was some hope among rural internet users that a service called Broadband over Power Lines (BPL) would come along soon to save the day by bringing them high speed internet at affordable prices. Not any more. American Telephone and Telegraph (AT&T) has a program in trials in Georgia that is a last grasp at trying to make the technology feasible without all the stumbling blocks encountered by other companies in earlier efforts. If AT&T’s engineers are successful, BPL may at last be rolling out on a large scale in the next five years.

Because internet service is a two way street, downloading data from a provider to a user and uploading data from a user to a provider, getting reliable, high speed internet to people in the countryside has been more complicated than the similar situation of stringing electrical service to those people in the middle of the last century. Satellite internet service is an option in the countryside, but is limited by slow upload speeds since consumers for good reason are not allowed by government regulation to possess enormously powerful transmitters. Satellite service providers also throttle their customers’ usage at certain limits because there is limited bandwidth available on a satellite.

Point to point microwave service has been an option for people living in or near small towns. It has been a rarely used option, however, because state and local laws passed at the behest of large internet providers hinder the ability of local governments to coordinate with small internet providers in setting up microwave service, which is most often undertaken as a public/private partnership. Cable television and landline telephone companies, where they have strung lines for internet service the last country mile, usually charge high rates on account of their monopoly status, with indifferent customer service also reflecting their status as an only option.

The last option left for some country people has been mobile telephone internet service. There are numerous problems associated with reliance on cellular internet service, from the possibility of poor signal to the certainty of data caps and high costs. It’s certainly not the best choice for regularly streaming video or trying to run an internet dependent business. The next generation of wireless data technology, 5G, will be available within the next few years, but it’s questionable whether it will solve the problems mentioned above. When a customer does have a solid connection to 5G service, it will be lightning fast.

The possibility of BPL had always seemed like a Godsend for rural internet users because it would have made connecting to broadband service as easy as plugging a modem into an electrical outlet, and because power lines have high capacity there would have been no need for data caps. The prices would have been relatively low by industry standards because the infrastructure was largely already in place, and because utility companies were more highly regulated than cable and telephone companies. “Would have been” is unfortunately where BPL will have to float in limbo, never to be a real option unless AT&T or some other technology company can resurrect it and make it viable.

Surprise, Surprise

 

After the Federal Communications Commission (FCC) five member board voted along party lines to roll back Net Neutrality regulations last month, it wasn’t surprising to see some major Internet Service Providers (ISPs) trot out rate increases soon afterward. The new regulatory structure doesn’t take effect until 60 days after it is published in the Federal Register, which may take a few more weeks while the FCC completes final edits to the paperwork, but companies like Comcast just couldn’t wait. Meanwhile, in another predictable outcome of the end of Net Neutrality, over 20 states have started instituting their own rules in an effort to adhere to the old guidelines, while also suing the FCC to prevent it from trying to impose its new rules within each state.

 

This comes down to regulating interstate commerce in the form of communications companies, which is the only reason for federal agencies such as the FCC to exist. It will all have to be sorted out in the courts, and that could take years and many millions of taxpayer dollars, all because FCC Chairman Ajit Pai turned a deaf ear to the majority of Americans while he listened very closely to his corporate masters, such as at Verizon, where he worked as a corporate lawyer before being appointed to the FCC by President Barack Obama, at the behest of Senator Mitch McConnell (R-KY).

There have been noises from Congress about legislating Net Neutrality, or a semblance of it, once and for all, thereby stripping the FCC of its bouncing ball regulations. Even if one of these measures manages to squeak by with enough votes in Congress, it will then cross the whistle-clean desk of Supreme Leader, who after all is the one who elevated Ajit Pai from FCC board member to chairman, most likely with the express purpose of encouraging him to gut Net Neutrality for the benefit of corporate giants. Supreme Leader will veto any legislation that undercuts his man at the FCC, and there will not be enough votes in Congress to override his veto, since that would require the votes of two thirds of the members.

In that case, it appears everyone will have to get used to paying through the nose for broadband internet service in areas of the country where there are only one or two providers, which is to say most areas. Consumers could pay less in a tiered system for service at the speed of dial-up, which is what the FCC has opened the door to now. Instead of being regulated like utilities, which must provide similar service to all consumers universally, the ISPs will be regulated like cable television companies, a business some of them have also been in for years.


The problem vexing consumers is that they usually have few choices for providers of these services, although they have slightly more choices than they do when it comes to their electric service. Still, in a market with limited competition, the advantage lies entirely with the unregulated company that is unfettered to charge whatever it can squeeze from captive consumers. Take it or leave it.

The last area where ISP giants are working to complete their cornering of the market is in the contest over municipal broadband services, which are usually public/private partnerships between municipalities and smaller ISPs, where the municipality provides some infrastructure and subsidies, and the private company provides the hardware, operations, and maintenance. Municipal broadband often provides better service and better rates to consumers than they can get from the big companies, and is likely to provide service to poor and rural consumers who otherwise would have no service options. No wonder the big companies are intensively lobbying state and local officials to choke off municipal broadband. It appears their greed compels them to throttle competition and now, at their discretion, some services to their customers.

Open Sesame

 

The latest crisis in computer security comes from news of the Meltdown and Spectre Central Processing Unit (CPU) exploits. Nearly all desktop and laptop computers are affected, and most tablets, smartphones, and other small devices are also affected.* The difference is on account of the types of CPUs used for the various computers and devices. Since home users usually access password protected accounts like email and online banking from smaller devices as well as larger computers, they could see their privacy and online security compromised across platforms. In other words, hackers can exploit a hardware flaw in the CPUs of home computers, and then hackers could use that vulnerability to access private email and banking passwords in software that crosses platforms.

CPU makers like Intel† are racing to fix the problem, which was first discovered by Google security researchers last June, and internet browser makers, where many users store passwords, are hurrying to tighten security on their end. In the meantime, people need to be vigilant about email and banking security themselves, starting with changing their passwords if they suspect unusual activity in their accounts and running a full suite of anti-virus, anti-spyware, and anti-malware programs on their computers. Those are routine security measures that people ought to be taking already, but unfortunately some folks don’t even do that much. When their computers are compromised by hackers, those home users are often as not completely unaware they are being used as part of a rogue network, called a botnet, to spread spam and other nasties throughout the internet. When everything is linked as with the internet, the weakest links are the easiest targets of hackers.

Even after tightening up individual computer security by using strong passwords and storing them securely, by not clicking on links in untrusted emails, by surfing the web safely using the anti-phishing feature built into most browsers, by regularly updating a security suite and running scans with it, even after all that a careful home user can still have difficulties, whether it’s because of something completely out of their control in the so-called cloud, such as when credit reporting agencies got hacked, or simply because their Internet Service Provider (ISP) momentarily gives them the Internet Protocol (IP) address of a blacklisted spammer, causing their email provider to block their account.

Since the majority of IP addresses are dynamic rather than static, meaning that each time a computer user connects to the internet the device that user is on, or possibly a larger network it is part of, is assigned a different IP address rather than keeping the same IP address from session to session. Because dynamic IP addresses are recycled, it’s a wonder that the unfortunate coincidence of being assigned a blacklisted address does not happen more often than it does. It’s impractical to remove a bad address from the rotation entirely because spammers can jump from address to address so quickly that soon all of them would be blacklisted, or the addresses would have to be prohibitively long.

The other way to get blacklisted as a spammer is to get hacked as described earlier, either through negligence or bad luck, and end up an unknowing part of a botnet distributing spam to friends and strangers alike. The use of biometrics like fingerprint and iris scans are no better a solution to account security than passwords since hackers have been at work on spoofing mechanisms for biometrics. Police can also compel people to grant access to their computers and other devices when they are locked by biometric measures, whereas they cannot compel people to divulge their passwords. There is no single, simple solution to keeping private data entirely secure on any computer or device as long as it is connected to the internet. It’s like the locks on doors and windows, which ultimately will keep out only honest people. Dishonest people will find a way in if they are determined enough, but it’s better for everyone else if it’s not too easy for them, and if they get caught sooner rather than later.

In Comcast We Trust

 

Recently one of the minority Democratic members of the five person board of the FCC took the unusual step of writing an article for distribution in the popular press urging the public to sit up and pay attention to what the majority Republican members of the board are attempting to do with a vote on December 14 to repeal net neutrality rules. Jessica Rosenworcel asked the public to make a fuss with the FCC and with Congress to try postponing the vote until after public hearings. The vote will likely still take place on the 14th, and the outcome is certain considering the three to two Republican majority on the Commission board. The next step will probably see the rule changes challenged in court, with litigation taking years.

Congress could change how a regulatory agency like the FCC goes about its business so that it is less swayed by the variable political winds, but it appears there is little will in the Republican Congress to overrule the agency and tie it down to enforcing a net neutrality law enacted by legislators. There is some discussion in technology circles that introduction of 5G wireless service in the next few years will change the competitive landscape since 5G speeds and bandwidth will challenge the monopoly of wired service providers for the crucial last mile of service to customers’ homes. Until now, wireless internet service providers like Verizon and AT&T could not compete with wired providers like Comcast and Charter because their service was slower and not capable of handling the bandwidth demands of home users piling up GigaBytes of usage every month, usually by streaming video.


5G may indeed change the competitive landscape between a few large internet service provider companies as it rolls out, but customers will still have to deal with fast lanes and slow lanes imposed by whichever gatekeeper they sign up with for service. The proposed FCC rule changes will allow ISPs to charge different content providers varying amounts based on tiers of service, rather than providing equal access to all as they are required to do now since they are regulated as public utilities.

When FCC Chairman Ajit Pai first proposed rolling back net neutrality rules early this year, Comcast said essentially “Trust us, we would never take full advantage of the regulatory opening to charge a premium for faster internet service.” As if anyone would believe them, particularly anyone who had any experience at all as a Comcast customer! Lately Comcast has walked back their earlier statement with some linguistic mumbo-jumbo that’s supposed to make people think they won’t be doing what they intend on doing when the time comes and they can get away with it, which will be to charge a premium for faster internet service and, as a bonus, no data caps! Comcast’s duplicity surprises no one, and their pleas for trust are laughable.

The best thing that can be hoped for by people who wish to keep a relatively open and inexpensive internet beyond December 14 is that the rule changes will be tied up in the courts for several years, and to some extent that will tie the grasping hands of some internet service providers who are eager to take advantage of the new rules to gouge content providers and customers. Beyond that, the best hope for a decisive, long term answer to the problem will have to come from Congress, which in the current environment does not appear possible, but may be so after a change in party dominance in Congress as a result of the 2018 election. The FCC needs to be more an enforcer of rules Congress makes, and less its own rule maker.

We’re Going to Need More Dimes

 

When it comes to net neutrality analogies, many people opt for the internet superhighway one where there may be fast lanes and slow lanes or, on a content neutral internet, all lanes are equal. Since it’s hard to bring in the gatekeepers who set the rules for the internet on that kind of analogy, it might be easier to think of net neutrality or non-neutrality as related to a toll plaza, where the gatekeepers, such as AT&T, Verizon, or Comcast, charge different amounts and cause varying delays to the vehicles attempting to pass through their gates.

 

On a net neutral superhighway, the gatekeepers at the toll plaza charge roughly the same amount to every vehicle and pass them all through with equal alacrity. On an internet superhighway that is not neutral and grants wide discretion to the gatekeepers at the toll plaza, toll charges vary a great deal from vehicle to vehicle, and the gatekeepers might also hold up certain vehicles, making them late to their destination.

FCC Chairman Ajit Pai, after going through the motions of a public comment period through the summer on his proposed, Orwellian-named “Restoring Internet Freedom” gutting of the 2015 net neutrality rules, announced today that the FCC board of three Republicans and two Democrats will vote on rules changes on December 14. The fix is in, as it has been since early this year when Mr. Pai expressed his intention to overturn the 2015 rules, and there is little doubt how the majority will vote on December 14. It is still possible between now and then to bring enough public pressure to bear on Congress for that body to influence either the FCC board vote, which is not likely, or put in motion legislation to override FCC rules on rescinding net neutrality, which is the more likely outcome, if there is to be a positive one at all for neutrality advocates.

Regulation of internet access is too vital to leave up to the unelected five member board of a regulatory commission. The current FCC board has also recently demonstrated its irresponsibility to the country at large when it did away with rules preventing monopolization of local media markets by a single company, recklessly opening the gates to allow Sinclair Broadcasting to consolidate its control across the country.

Congress could put an end to FCC favoritism toward big business by passing legislation, instead of allowing the FCC board to vote on rules after the formality of a meaningless public comment period, since the board Republicans will almost certainly vote against net neutrality despite the majority of public comments in favor of it. Congress is also beholden to big business, but at least it retains some ability to bend to the public will. As it stands now, after the December 14 vote the new rules will likely get challenged in court, and the legal struggle will eat up years, and all the while the internet gatekeepers will make fortunes extorting internet users who need to pass their toll booths.

Not Everyone Likes Pai

 

Ajit Pai, Chairman of the Federal Communications Commission (FCC), requires confirmation by the Senate as a board member before the end of the year to continue with the agency. If he is not confirmed for another four year term and is removed from office, the current president will most likely replace him with another Republican and advance the nomination of that person or another of the board’s two Republican members to the chairmanship. In the end, getting rid of Chairman Pai may not alter the current course of the FCC toward revoking Net Neutrality rules and allowing the merger of the Sinclair Broadcast Group with Tribune Media, but his removal does offer the opportunity to change course, however slim that may be.

Since his advancement to the chairmanship at the beginning of the year, Mr. Pai has worked to dismantle Net Neutrality under the Orwellian rubric “Restoring Internet Freedom”. The public comment period on the proposed rule change closed at the end of August, and now everyone awaits the decision of the five member board, three Republicans and two Democrats. It’s difficult to say what may be taking so long, considering that Mr. Pai has the votes, and by his actions earlier in the summer it appeared the fix was in anyway. Perhaps he’s having a hard time drafting the new regulations and lowering the bar enough to reflect proper deference to the major players like Comcast.

The other major issue on Chairman Pai’s agenda is the merger of Sinclair with Tribune Media, which he favors. To advance his position for taking away regulations that treat Internet Service Providers as common carriers and therefore subjects them to rules of Net Neutrality, Mr. Pai uses language about protecting the consumer and getting the government out of the way of innovation, yet when it comes to allowing one enormous broadcast company, Sinclair, to become even larger and therefore monopolize some smaller media markets around the country, he suddenly and conveniently forgets his previous arguments. Monopolies have historically neither looked out for consumers in any way other than to take their money, nor have they had any incentive to innovate in any way other than how to take even more money.


The comments from the public in favor of keeping Net Neutrality regulations in place have outstripped the comments against, and to the limited extent the public has been paying attention to the Sinclair/Tribune merger, most are against it. Will the FCC, and in particular Chairman Pai, listen to the public or to corporate interests? It’s not hard to imagine the answer to that question if you subscribe to the wisdom of the comedian Lily Tomlin, who said “No matter how cynical I get, I can’t keep up.” Be that as it may, the public retains the option through Congress to say to Mr. Pai “You’re fired!”
