Charlie Don’t Surf

 

“Charlie, that’s beneath you,” Steve Bannon told interviewer Charlie Rose on the 60 Minutes television program this past Sunday, referring to Rose’s remark that we are a nation of immigrants except for the Native Americans. Bannon’s statement was bizarre and nonsensical, and seemed to come from his own peculiarly politicized vision of American history in which admitting that European immigrants largely stole the Western Hemisphere from Native Americans in a shameless display of cupidity and genocide is somehow nothing more than shameful leftist propaganda. So much for honestly facing the truth.

Even though Mr. Bannon is out of the White House now, his legacy lives on in the administration’s immigration policy, specifically the recent announcement about ending the Obama era DREAMer policy of granting a path to citizenship for children of illegal immigrants. Mr. Bannon does not appear to care for immigrants, legal or otherwise, no matter what sort of intellectual gloss he slops onto his elitism. He is an unsavory man who sees nothing wrong with declaring war on the brown-skinned peoples of the earth, as long as people other than him and his kind are doing the fighting. The short termed White House Communications Director Anthony Scaramucci, in his own succinct way, characterized Bannon absolutely correctly. Mr. Bannon is someone who takes himself too seriously, and is accustomed to overawed admirers reinforcing his own high opinion of himself.

For all that, what do Mr. Bannon’s ideas amount to? Not much other than what can be found in the writings of Rudyard Kipling – the White Man’s Burden and all that – but without Kipling’s compassion. Steve Bannon is a man out of his time, which rightly should be about 150 years ago. Perhaps that was when America was great for him and his kind, or at least it was if he ignored the multitude of recent German and Irish immigrants, the millions of African slaves recently freed after the bloody Civil War, and all the Mexicans still at large in the new territories and states of the American southwest as a result of the giant land grab known as the Mexican-American War.

In that world, Mr. Bannon would no doubt have felt at home because his cognitive dissonance about American history would not have been noted by his contemporaries. He would instead have been part of the mainstream of Old Boy elites riding high on the backs of immigrant and poor persons’ labor, while snootily ignoring that fact and looking down on them, the source of his wealth, and of his leisure to engage in what amounts to little more than mental masturbation. Maybe that’s what he meant when he said “Charlie, that’s beneath you.”

We the People

Tuesday the nation celebrates independence from the British Crown and eventual establishment of a democratic republic. That’s the story, at least. Of the independence part there is no doubt, because that is pretty straightforward. It’s the democratic republic part that doesn’t quite coincide with historical reality, and certainly not with what the United States of America has become today. Today it is an oligarchy, and looking back over the history of the country it becomes clear the inclination was always present.

 

The Founding Fathers were never for a broadly based democracy, instead leaning toward governance by a limited set of people – white males with property. Some Founding Fathers, Jefferson, Madison, Adams, and Washington among them, believed the democratic republic would be stronger if more people owned property, or capital, and therefore had a say and a stake in governance. Though they were rather wealthy men themselves, they would probably be horrified at the current state of income inequality in this country and how that has wrought havoc on the democratic republic they established.

Suffrage has broadened greatly since the eighteenth century, but a vote for candidate A over candidate B makes little difference when both candidates are backed by the same small clique of financiers and corporate boards. Once the candidate is in office, he or she tunes in the oligarchy and tunes out the voters, at least until the next election. Of what use then is a vote when the person voted for doesn’t represent your interests when in office, will often in fact work against your interests? Strangely, people will vote for that person again two, four, or six years later.

Franklin Delano Roosevelt understood there is no real political power without economic power. Enactment of his proposed Second Bill of Rights is long overdue.

To regain political power, the people need to take back wealth; to regain wealth, the people need to take back political power. Hand in hand. Remember the capitalist credo: Money talks. We have the honesty of the Supreme Court to thank for enshrining in the 2010 Citizens United decision what everyone has always known, going back to the days of the Founding Fathers, it’s just that Washington, Adams, Madison, and Jefferson had the wisdom to understand the money should be spread around a lot more in order for the government to listen to we the people.

A Pitch Too High

 

In trying to specifically target their advertisements and therefore get a higher return per ad, companies like to know as much as possible about the consumer, and lately some of them have resorted to using ultrasonic beacons embedded in their ads. Say you are at your desktop computer reading a news story from the online version of your local newspaper, and nearby on your desk is your smartphone, which is on but currently idle, or so you would assume. Unknown to you, one of the ads on the webpage you are looking at emits an ultrasonic beacon lasting about 5 seconds through your computer’s speakers. Most likely also unknown to you (because like most people you probably don’t bother to read all the permissions you grant an application when you install it), one or more of the applications on your smartphone pick up that ultrasonic beacon through the phone’s microphone and, through various commercial agreements also done without your knowledge, relays the packet of information encapsulated in the beacon, along with information contributed from the smartphone application, back to the advertiser on the webpage as well as to anyone else who has an interest in information about you.

 

The more advertisers know about you, the better, as far as they are concerned. The problem here is how sneaky they are being about collecting information. It is even possible for advertisers to embed ultrasonic beacons in television advertisements, though so far there is no proof any of them have done that. The Federal Trade Commission (FTC), which regulates deceptive advertising practices, nonetheless recently warned 12 smartphone application developers about deceptively implying they were not monitoring users’ television viewing habits when in fact they were capable of doing so. Researchers recently discovered that as many as 234 Android applications are capable of using beacon technology. Unfortunately, it appears the FTC is reluctant to force the developers to divulge this capability to Android smartphone users. There is even less information available from Apple application developers.

This cross-device tracking, as it is known, is as invasive and sneaky as it gets, yet there seems to be little political will to either outlaw it or regulate it. A warning letter? That’s all? In the 1950s and 60s there was a public outcry about subliminal messages in print and television advertising. While the effectiveness of subliminal advertising has always been dubious, people were nevertheless upset they were being manipulated in such a sneaky, underhanded way. Because of the public outcry, the Federal Communications Commission (FCC) was moved to state it would revoke the license of any broadcaster who used subliminal messages in programming or advertising, and the FTC stated that it would prosecute advertisers under Sections 5 and 12 of the Federal Trade Commission Act of 1914, which governs deceptive practices.

 

Given the remarkable similarity of ultrasonic beacons in electronic devices to subliminal messaging, in practice if not in usage, it’s difficult to understand why the FCC and FTC have not come down harder on the commercial use of this technology. The practice is the same because both seek to take advantage of consumers without their knowledge, and certainly not with their explicit approval; the usage is different because subliminal advertisers cast a wide net to boost sales, while companies employing beacons gather information about users in order to more specifically target them, like fish in a barrel. Until federal regulators take stronger action against the use of ultrasonic beacons, people upset by the practice will apparently have to rely on the more acute hearing of their dogs to alert them.

Don’t Ask, Don’t Tell – Immigration Version

 

It seems it is human nature to need someone or some group to look down on and cast as the reason for one’s misfortunes. From vilification of Jews and now Muslims, to hatred of black people and now brown people, a lot of folks are always looking for a scapegoat. The rich and powerful know this as well as anyone, and are quick to take advantage of this tendency when it serves to turn away the attention of the masses from the true source of their economic stagnation, which is to say the kleptocracy of the rich and powerful.

This one was built by the Romans in the reign of the emperor Hadrian on the border of England and Scotland, to keep the Scots out of England. It turns out the Scots had more to fear from the English, just ask any Scot.
While it is no longer acceptable in open civil discourse to rant about the evils of the Jews and the blacks, and that sort of talk has been relegated to private conversations among like-minded peers, feelings of xenophobia and revulsion at The Other have found their outlet in public condemnation of Muslims and brown people as long as it is couched in terms of protection from terrorists or crackdowns on illegal immigration. There is probably just as much racism and visceral need for scapegoats as ever, it’s just that now, at least in public, peddlers of base emotional venting know to use code words and dog whistles. Everyone knows what the peddlers mean, but everyone can maintain deniability, whether plausible or not is a matter left to an individual’s tolerance for hypocrisy.

 

Regarding illegal immigration specifically, the facts are not as scary as the current administration cynically pretends they are, and there is a decent compromise solution called “permanent non-citizen resident status”, which the political science scholar Peter Skerry explains at length in a 2103 article in National Affairs. It’s interesting to note that since many Hispanic illegal immigrants are young men away from home and family and view their presence in the United States as a temporary employment situation only, they tend to be insular and not always on their best behavior, two characteristics which contribute to a poor view of them by the resident, mostly Anglo population.

The workers were “settlers in fact but sojourners in attitude.” . . . Not surprisingly, such transience is not confined to the workplace. Young people detached from the constraints as well as the supports of families back home exhibit what one sociologist refers to as “instrumental sociability,” characterized by transitory friendships, casual sexual encounters, and excessive drinking to a degree uncommon back home.

The phrase “instrumental sociability”, when referring to Hispanics, can conjure up a tinge of Tortilla Flat stereotyping, but the more accurate similarity in reference is to another subgroup in our culture, the military. The military also is composed of mostly young men who are away from home and family in what they view as a temporary situation, and they maintain an insularity from the community at large where they are based out of what amounts to a mutual, tacit agreement with the locals. The analogy doesn’t go far before breaking down, such as in discussions of the presence or lack of strong leadership and policing within the subgroup, but still it is ironic that many of the people in the larger culture who adulate the military with nearly onanistic devotion are the same ones who most loudly berate brown-skinned “illegals”.

Before people with middle class and higher incomes, with college or higher educations, and with supposedly refined ethics, start congratulating themselves over how they are above looking down on people and scapegoating one group or another, they might reflect on the rhetoric following the 2016 presidential election when people just like them, and perhaps they themselves, were quick to berate stupid, bigoted rednecks for the disastrous outcome. The caricature that emerged of the typical voter for the Republican winner was of an Anglo male, middle-aged and older, working class and possibly unemployed, and an uneducated bigot as well. While that demographic did make up a significant part of the winner’s constituency, it was not the majority. The picture that has emerged of the majority is of people with middle class and higher incomes, with college or higher educations, possibly with refined ethics, and a great many of them were female. It is simpler and more satisfying, however, to berate the stupid, bigoted rednecks living in the trailer park on the other side of the railroad tracks than it is to grapple with how it is that your neighbor on your suburban cul-de-sac, the nice one you’ve known for thirty years and who looks after your place while you’re away on vacation, how that kindly neighbor could have voted that way and done that to you.

This is meant as no defense for being a redneck, because unlike other personal characteristics it is not intrinsic and immutable, but rather the culmination of a number of repugnant beliefs, attitudes, and behaviors. People confuse rednecks with good ol’ boys. They are not the same. The protagonists in Deliverance were good ol’ boys; the moronic backwoodsmen they tangled with were rednecks. All this appears to stray far from the discussion of scapegoating illegal immigrants, but not really, because the outcome is ugly whatever the source, high or low, and whether the people at the receiving end are “bad hombres” or “deplorables”.

I Have Nothing to Hide

In any discussion of government surveillance, such as has been revealed by the recent WikiLeaks “Vault 7” release of CIA documents, there are some folks who are apt to pipe up with “Let the government spy on me – I have nothing to hide.” By that they presumably mean for their listeners to understand they are not terrorists, criminals, or perverts, and to drive home their utter lack of impure intentions they will often add a feebly humorous aside about how government agents would fall asleep from the boredom of eavesdropping on them. How reassuring to learn that government flouting of the Fourth and Fifth Amendments to the Constitution is okay because there are some among us who are without sin! Whether these folks realize it or not, their smug pronouncement comes out of them because in their lives the presumption of innocence has always been a given, and therefore government agents would have no interest in their good citizen behavior. It doesn’t seem to occur to them there are others in our culture who, through no fault of their own, are presumed guilty, and there are still others who are just as law abiding as the “nothing to hide” crowd, but may be concerned about hackers and thieves accessing their data, or simply want to be left alone and feel that their affairs are their own and should not be the concern of the government. We can use locks on our doors not only to keep out criminals after all, but nosy neighbors and government snoops as well.

The digital age has changed the game somewhat by introducing new channels of communication and cheap storage for vast quantities of information. The Fourth and Fifth Amendments are no less valid, however, in stating that citizens should be secure in their “effects”; that government officials need warrants; that citizens cannot be compelled to testify against themselves; and that government shall follow due process of law in proceedings against any citizen. Naturally the Founding Fathers did not foresee the age of computers, smartphones, and the internet. They didn’t need to foresee those things, because in looking back on thousands of years of ancient Roman and Greek law and English common law, they were able to extract valid principles which were applicable to the general human condition whatever the particulars of any one era might be. Since their time, we have moved from postal mail and personal messenger to phone calls and telegrams, and now to blog posts and email. Government snooping amounts to the same thing whatever the means of communication, and it is protection from the ends that the Founding Fathers wrote into the Constitution.

That much should be obvious, yet the erosion of the Bill of Rights continues bit by bit, often with the excuse that technology has wrought different contingencies in our modern era. There are no different contingencies – what has changed is that the state of emergency appears now to be permanent because it suits the agenda of powerful interests in the military-industrial complex. In the past, the United States government trampled rights for various reasons which seemed sensible to many at the time, from the Alien and Sedition Acts of 1798, to the Palmer Raids of 1919 and 1920, to the internment of Japanese-Americans in World War II. Always the advocates of such policies invoked a state of emergency to justify the abuse of state power, but eventually calmer heads and changing circumstances would prevail and the balance would be corrected.

As long as there are enablers of government snooping who complacently and self-righteously announce to everyone within earshot that they “have nothing to hide,” dislodging the powerful interests invested in the current status quo and restoring a constitutionally correct balance between citizens and government will be a protracted struggle. Those who value the privacy of their communications enough to take measures to protect it, such as by using the Tor internet browser or encrypting their emails, are thereby presumed guilty of possible anti-state, criminal, or sexually deviant enterprises by government snoops and their sanctimonious “nothing to hide” enablers because the very action of taking privacy measures draws scrutiny from those groups and is something they deem an admission of being up to no good. It is as if the Fourth and Fifth Amendments have been turned upside down, and objecting to having snoops looking in the windows of your house and walking in through the front door any time they please is fussy obstructionism, definitely unpatriotic, and possibly prosecutable. The “nothing to hide” folks are unconcerned over these developments, secure as they are in the comforting knowledge of their own innocence, though they may want to keep in a corner of their uncluttered minds the notion that the perception of innocence by those in power can shift capriciously, and so they are well advised to note this paraphrased bit from a poem by the German Lutheran pastor Martin Niemöller: They came for the Privacy Advocates, and I did not speak out – Because I had nothing to hide.

Nomophobic No More

 

Nomophobia is a term coined in 2010 by the United Kingdom Post Office, which commissioned research into the anxieties of mobile phone users. It stands for no-mobile-phone phobia, or the fear of not having access to a phone or phone service.

On February 3, 2017, New Orleans Saints head coach Sean Payton, responding in part to the antics of Pittsburgh Steelers wide receiver Antonio Brown, who streamed a post-game speech by his head coach, Mike Tomlin, on Facebook Live from his smartphone, vowed to “scramble” social media sites in the Saints’ locker room in the future. It was unclear what Payton meant exactly by “scramble,” but perhaps he was referring to using a filter on the locker room wi-fi service. Players could still access social media sites using the signal from their cellular service, however, making the overall effectiveness of Payton’s ban doubtful. A cell phone signal jammer would be an option if it were legal.

Payton’s proposed ban was his response to players’ increasing inattention as well, since they itched to check their phones for distractions instead of devoting their full attention to the business at hand in locker room meetings. These are men in their twenties and thirties, some of them making millions of dollars a year, and they cannot be relied upon to disregard their smartphones for more than forty minutes at a time while their head coach conducts a meeting. But then, considering the behavior some players exhibit during games, perhaps it should come as no surprise they are selfish and immature in other areas of their lives. We would more usefully order our priorities to not give the players and the game as much attention as we do.

Whether it is a compulsion or an addiction that many people have to constantly check their smartphone for text messages, emails, or social media posts, is something they need to examine for themselves. The rest of us just wish they would stop checking, checking, and checking again, because it is costing us time and frustration, and in some cases our lives. Besides the everyday annoyances caused by compulsive smartphone users disrupting the enjoyment of theater-goers and patrons at restaurants and shops, there is the now nearly constant problem of being held up at a traffic light by the driver in front being too engrossed in their smartphone to realize the light has turned green. Such drivers build up road rage in others, and that’s minor considering the dangers they pose once they get their car moving.

A majority of drivers sensibly acknowledge that texting and driving is dangerous and are in favor of state laws prohibiting it, yet many of them continue to do it. You can see these drivers everywhere on the roads, bobbing their heads up and down like mechanical dipping birds as they look up and down from the smartphone they hold down just out of view of others – as if they’re fooling anyone – to the road and back again. The danger comes not only while they are looking down, but also for the first few seconds after they look up, because in that time their minds are elsewhere.

Since some people can’t seem to stop themselves from texting and driving, and since enforcement is lax, it appears the only thing that will get at least some of them to stop is the kind of social disapproval that has built up around smoking in public over the past twenty years. It’s incredible now to recall that up until twenty or thirty years ago smoking in most public places was not only acceptable, it was the norm. People smoked in theaters, restaurants, and on planes and trains. Like enjoying green eggs and ham, people had a cigarette pretty much anywhere they liked. Speaking of green eggs and ham, now there’s an excellent idea: shut off that phone, smart or otherwise, and enjoy an attentive meal with friends or family, put the phone to sleep in the glove compartment while you drive to the theater, and then leave it in the car when you go in to relax and enjoy the show. Your dinner companions, the drivers you share the road with, and your fellow patrons at the theater will appreciate it, and it won’t kill you.

I’ll Have the General Tso’s Chicken

January 28 is the Chinese New Year, which this time is the Year of the Rooster. The Chinese celebrations include an acknowledgement of America’s current influence on their culture, and in reply the Supreme Leader no doubt will wish “Good Luck” to all our Chinese friends, perhaps with a tweet or a cluck. Moving from the ridiculous to the sublime, we look back on Ernest Henry “Chinese” Wilson (1876-1930) and his accomplishments in bringing hundreds of Chinese plant varieties to Westerners in the early years of the Twentieth Century.

 

“Chinese” Wilson was English by birth, and he started out on his plant collecting in China on behalf of the English firm of James Veitch & Sons, who primarily sent him to retrieve the Dove Tree, Davidia involucrata. Wilson made numerous trips to China, Japan, and other Eastern, African, and Latin American locales over the first twenty years of the Twentieth Century, eventually collecting plants on behalf of the Arnold Arboretum in Boston. In 1930, he and his wife died in an automobile accident in Worcester, outside of Boston.

Wilson sent back to the West a staggering number of plant species, many of which, like Camellia, Magnolia, Azalea, and Crepe Myrtle, while not entirely unknown here before his collection efforts, have become so common since he gathered their multiple varieties that Westerners could be forgiven for thinking they have always been here. Wilson himself was most proud of his discovery in 1907 of the Regal Lily, Lilium regale, on an expedition to the Min River valley in western Sichuan Province, where he paid the high cost of having his right leg broken in two places in a rock slide. He made it out of the wilds safely in three days and recovered, but ever after he walked with a limp.

 

This New Year of the Rooster it does us good to remember a good man, “Chinese” Wilson, and his positive contributions to the Western world borne of his expeditions to China and the Far East. It’s better still to think of how the Chinese reservoir of plant diversity has enriched our own gardens. And it’s best of all to realize in these difficult times that the influence of Wilson’s good work will over the long run outweigh the tribulations visited upon us by one petulant, puffed-up rooster of a man. The General Tso’s Chicken is good; let’s enjoy that and leave aside for now it’s American variant, Orange Chicken.
